7. Out-of-court dispute resolution (post-2025 position)
The European Commission’s Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025 pursuant to Regulation (EU) 2024/3228 of the European Parliament and of the Council, repealing Regulation (EU) No 524/2013. There is no longer a single EU-wide ODR portal to which the service provider is required to link.
Polish Consumers may instead apply to a competent national alternative-dispute-resolution (ADR) body, in particular:
- the Wojewódzki Inspektor Inspekcji Handlowej (WIIH) competent for the service provider’s registered seat;
- the Stały Polubowny Sąd Konsumencki (Permanent Consumer Arbitration Court) operating alongside it;
in accordance with the Polish Act of 23 September 2016 on Out-of-Court Resolution of Consumer Disputes. A list of competent Polish ADR bodies is maintained by UOKiK (the Polish Office of Competition and Consumer Protection) at polubowne.uokik.gov.pl.
Consumers in other EU/EEA Member States may use their national ADR body competent for their place of residence and, for cross-border consumer disputes, the European Consumer Centre Network (ECC-Net) at eccnet.eu.
Engagement in out-of-court consumer dispute resolution is voluntary on the service provider’s part, save where Polish or EU law makes it mandatory in respect of a particular dispute.
This section is consistent in substance with Section 14.5 of the Terms of Service; in the event of any discrepancy, the Terms of Service prevail.
